Councilman David Marks might fine you for others’ crimes

If someone else breaks the law, should you be the one who gets punished for it?

Councilman David Marks has introduced a new bill designed to extort property owners based on illegal actions of their tenants.

In other words, Councilman Marks seems to believe that government should be able to punish one law-abiding person even though a different person broke the law.

More specifically, Bill 58-15 would require landlords to pay up if their tenants hosted “unruly gatherings” involving underage drinking or any “other conduct which constitutes a threat to the public safety, quiet enjoyment of residential property, or the general welfare.”

The bill claims that if tenants host an unruly gathering, then that means the landlord “allowed” it to happen and is therefore at fault.

This is an unethical attempt by Councilman Marks to use intentionally deceptive and false reasoning to oppress a certain class of people, namely landlords and property managers.

Not only are Councilman Marks’ demands oppressive, they are completely impossible to fulfill.

Even in the unlikely event that a landlord has received timely knowledge of an unruly gathering at the property, a landlord has no legal authority to forcibly intervene by kicking tenants off the property and breaking up the gathering.

All a landlord can do is follow lawful eviction procedures, which can take weeks.  In the meantime, David Marks wants to keep fining the landlord for every unruly gathering that tenants host on his or her property.

Not only does Councilman Marks want to place civil penalties on landlords for each separate unruly gathering, but he expects the landlord to pay the county’s cost of removing the nuisance from the property.

This begs the question…why do we pay taxes when the county wants to also bill us separately for its services? 

While Bill 58-15 states that the tenant would be punished as well, passing on the blame to a landlord or property manager is ridiculous and unfair.

If we accept the principle that one person can be punished for the uncontrollable actions of others, then power-hungry, big-government politicians will have every incentive to use this principle to come up with more and more ways to extort and control us.

What if a crime happens in a business owner’s parking lot?  Do we fine the business owner because he or she didn’t add extra security guards to the payroll, or didn’t build an expensive security gate around the premises?

It seems that Councilman Marks would probably say yes, because in his mind the business owner  “allowed” the crime to happen.

What if curfew laws passed and some kids in violation of the curfew happened to take a shortcut through your yard when police (or a nosy neighbor) spotted them?

By David Marks’s reasoning, you “allowed” that to happen. Since you weren’t constantly monitoring your yard and didn’t immediately notify the authorities, clearly you have helped these children violate curfew and you will be fined for providing a “curfew free zone,” whether you did so intentionally or not.

What if your son or daughter committed a crime that you took no part in?  David Marks probably wants to punish you too. After all, you must have “allowed” the crime to happen by not raising and supervising your child the way government wants you to.

The end result here is that the only way to supposedly prove we haven’t “allowed” a crime to happen is to give up all our liberties and do whatever ridiculous and counterproductive actions that politicians demand of us.

While Bill 58-15 only applies this unjust principle to select victims (landlords and property managers), it’s important to recognize that this is a seed of tyranny that can grow into something much worse and affect more people if politicians believe they can get away with it.

Don’t let them get away with it! CHIP IN HERE to make sure funds are ready to widely expose attempted power grabs like this one!

Let’s CRUSH this tyrannical principle of punishing innocent people for crimes committed by others.
